In the digital age, every individual has their data on the internet. They are either collected through cookies or by uploading the information themselves. How safe is the personal data saved on the internet? How do we know if the personal data is being used by entities unknown to us? Is the personal data being sold to third-party entities? Numerous questions come to everyone surfing on the internet. This course will help the students understand the concept of cyberspace and the issue of jurisdiction as it has no boundaries. In addition, the course will delve into the concept of privacy in both traditional and modern sense covering an important aspect of information privacy. To combat the issue of privacy, there have been regulations set in place in the form of GDPR for EU countries and in India in the form of the Information Technology Act, 2000 and SDPI Rules, 2011. The SDPI Rules, 2011 are now replaced by the Digital Personal Data Protection Act, 2023. We will go deeper into the concept of consent, the different parties and regulatory authorities involved and the implementation of the law.
Who should be doing this course?
The course starts with an introduction to cyberspace and understanding the grey area of jurisdiction. The next module introduces the concept of privacy in the traditional sense with the help of judgments to interpret the meaning of privacy. Special emphasis is given to the landmark case Justice K.S Puttaswamy & Anr. V. Union of India concerning informational privacy. The course will further explore the GDPR rules and principles. Concerning India, we will first look at the IT Act, 2000 and SDPI Rules, 2011 concerning sensitive personal data. With the rising concern about the protection of personal data and its commodification to third-party entities, the Digital Personal Data Protection Act was introduced in 2023. In this course, we will look into introducing the Digital Personal Data Protection Act, of 2023 and its impact. The course will give you a deep understanding of consent, the role of data fiduciaries and enforcement of the laws in GDPR and DPDPA, 2023.
